University currently operates its own trademark licensing and logo program (Program) involving hundreds of licensees. University has had an assessment of the Program performed and is ready to move forward with the procurement of consulting services to assist in implementing the assessment recommendations, including possible consolidation of the apparel licensee base. The possible consolidation of the licensee base would be implemented using a public, competitive procurement process. Please do not respond to this request letter exclusively by telephone or merely by sending marketing brochures. Feel free to make suggestions, in addition to responding to the questions. The University is seeking information to use in negotiating a contract for consulting services to possibly consolidate its apparel licensee base through a phased process that involves the development of a competitive procurement, evaluation of responses to such procurement, due diligence analysis of and negotiation with potential partners to provide the best value for University, recommendations for best value award and development of key business terms for use in the final agreement with the selected partner(s). Successful respondent will implement and manage a process to consider consolidation of apparel licensees currently managed by the Program. The recommendation for consolidation is defined in a University assessment report that contains key findings and actionable recommedations for program optimization and incremental growth. The report recommends the grant of an exclusive or partial exclusive license within apparel to capture greater share of financial upside, stabilize downside risk, and maintain better control over brand messaging and product quality. It is imperative that Program be structured and operated to maximize revenue and incremental revenue growth to University. The goal is to implement identifed national best practices for trademark licensing programs. Specific actions the successful respondent will be expected to take as they implement and manage the new program include: Develop a competitive procurement, in close consultation with key University personnel, to consolidate or partially consolidate University appararel licensee base using key criteria that will allow for effective evaluation of prospective partners. ; Implement competivite process including identifying prospective proposers and responding to questions in coordination with key University personnel. Evaluate responses to the competitive process and make comprehensive best value recommendations to University. Evaluation will include (1) considering key elements within each proposal and a comparison across all submissions; (2) identifying critical factors that will have a positive or negative impact on the program; (3) ranking proposing parties based on quality of responses (qualitative and quantitative) and overall ability to meet critical objectives outlined by University. Provide due diligence and negotiation on behalf of University with a selected subset of proposers or potential managers of the licensee base. Due diligence should include, but is not limited to (1) financial considerations; (2) experience with single source, category or channel exclusives; (3) staff and resource commitment; (4) academic enhancement opportunities and (5) other factors determined in consultation with University. Provide final report that identifies and quantifies the potential tradeoffs to University and its trademark licensing program in pursuing a partnership with each party including facilitation of in-person meetings with prospective partner(s). The final report should include original competitive procurement submissions and any further written materials, in-person meetings, reference checks, and third party research. Provide guidance to the University about the structure and negotiation of contract(s) with the selected party(ies) including recommendations about proposed business terms. Qualifications: Demonstrated experience with trademark licensing and management programs, preference given to respondents with demonstrated understanding of collegiate trademark programs Demonstrated knowledge of trademark licensing industry history and current trends Demonstrated ability to manage a licensee consolidation process and/or provide consulting services that involve the evaluation of prospective partners to license and manage national brands Ability to carry out program implementation and management with multiple campus and external stakeholders using discretion and professionalism Demonstrated understanding of trademark management and compliance, licensee relationship management, and university trademark and logo marketing, Ability to manage project effectively using both pre-existing industry knowledge plus University specific information.
